မန္မာႏုိင္ငံဟာ “crime against humanity” ကို က်ဴးလြန္ျခင္း ရွိပါသလား

ကဲ - OIC က ကၽြန္ေတာ္တို႕ ျမန္မာႏုိင္ငံကို UN တင္မယ့္ ေခါင္းစဥ္က“crime against humanity” လို႕ ဆိုပါတယ္။ (It described as a “crime against humanity” the Myanmar government’s handling of minority Muslims.)R2P- responsibility to protect Civilian မွာ ပါတာက (၁) genocide, (၂) war crimes, (၃) ethnic cleansing နဲ႕ (၄) crimes against humanity ဆိုျပီး ရွိပါတယ္။ crimes against humanity က အနိမ့္ဆုံး ဆိုပါေတာ့။မၾကာေသးခင္က ျမန္မာႏုိင္ငံဟာ ethnic cleansing လုပ္ေနတာ မဟုတ္ပါဘူးလို႕ အေမရိကန္ႏုိင္ငံျခားေရး၀န္ႀကီးဌာနက ထုတ္ ေဖာ္ ေျပာၾကား ထားတာ ရွိပါတယ္။ ethnic cleansing မဟုတ္ဘူးဆိုေတာ့ အဲဒီထက္ ပိုျပီး ျပင္းထန္တဲ့ "လူမ်ဳိးတုံးသတ္ျဖတ္မႈ genocide" နဲ႕လည္း တင္လို႕ မရေတာ့တဲ့ သေဘာမွာ ရွိပါတယ္။ "War Crime" ဆိုတာကေတာ့ ပိုျပီး မျဖစ္ႏိုင္ေတာ့ဘူး။


ဒီေတာ့ အေထြေထြညီလာခံမွာ တင္သြင္းမယ့္ ေခါင္းစဥ္က “crime against humanity” ဆိုျပီး ျဖစ္လာတာပါ။ ဒါဆိုရင္ “crimeagainsthumanity”ဆိုတာဘာလဲၾကည့္ဖို႕လိုပါတယ္။


The definition of what is a "crime against humanity" for ICC proceedings has significantly broadened from its original legal definition or that used by the UN, and Article 7 of the treaty stated that:

For the purpose of this Statute, "crime against humanity" means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledgeoftheattack:

(a)Murder;

(b)Extermination;

(c)Enslavement;

(d)Deportationorforcibletransferofpopulation;

(e) Imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of internationallaw;

(f)Torture;

(g) Rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other formofsexualviolenceofcomparablegravity;

(h) Persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender as defined in paragraph 3, or other grounds that are universally recognized as impermissible under international law, in connection with any act referred to in this paragraph or any crimewithinthejurisdictionoftheCourt;

(i)Enforceddisappearanceofpersons;

(j)Thecrimeofapartheid;

(k) Other inhumane acts of a similar character intentionally causing great suffering, or serious injury to bodyortomentalorphysicalhealth;


ဘဂၤါလီေတြနဲ႕ စပ္လ်ဥ္းျပီး ျမန္မာႏိုင္ငံအစိုးရရဲ႕ ကိုင္တြယ္ေျဖရွင္းမႈဟာ “crime against humanity” ကို က်ဴးလြန္ရာ ေရာက္ေနပါသလား။

နဂိုကမွ ရႈပ္ေထြးေနတဲ့ ဒီကိစၥဟာ အခုဆိုရင္ ဖြင့္ဆိုခ်က္ေတြ၊ ဆုံးျဖတ္ခ်က္ေတြနဲ႕ ပိုျပီး ရႈပ္ေထြးလာမယ့္ သေဘာပါ။ ဘာပဲျဖစ္ျဖစ္ OIC က အေထြေထြညီလာခံမွ တင္လာရင္ သူ႕ဘက္ ကိုယ့္ဘက္ ျငင္းၾက ရွင္းၾကနဲ႕ Conference Diplomacyကိုဆက္လက္ေဆာင္ရြက္ၾကရမွာပါ။


သူတို႕ OIC ကေတာ့ (၅၇)ႏိုင္ငံ ပါ၀င္ေနတာ ျဖစ္တဲ့အတြက္ ေထာက္ခံမဲ ၅၇ မဲ ရရွိထားတဲ့ အေနအထားပါ။
